These Terms of Service (“Terms”) govern your access to and use of the BarkPass website, applications, and related services (the “Service”), provided by BarkPass, LLC (“BarkPass,” “we,” “our,” or “us”).

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.


1. Use of Service

The BarkPass Service enables you to purchase pet licenses, register for dog park passes, and access related municipal services. You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations.


2. Account and Information Accuracy

When creating an account or making a purchase, you agree to provide accurate, current, and complete information, including required documents for your pet (e.g., proof of rabies vaccination). You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.


3. Communications by Email, SMS, and Voice

By providing your email address and/or mobile phone number, you consent to receive communications from BarkPass regarding your account, purchases, renewals, and related services.

SMS/Voice Communications (via Twilio)

  • Service Messages: BarkPass uses Twilio, Inc. to deliver SMS and voice communications. These may include confirmations, reminders, alerts, and account updates.
  • Message Frequency: Varies based on your activity and service requirements.
  • Opt-Out: You may opt out of SMS at any time by replying STOP to a message. Reply HELP for assistance. You may also contact BarkPass support to manage preferences. Opting out may affect delivery of certain Service features.
  • Charges: Standard carrier message and data rates may apply.
  • Marketing Messages: BarkPass will only send promotional or marketing texts if you have expressly opted in to receive them.

Email and Marketing Communications (via Instantly.io)

  • BarkPass may use Instantly.io and similar providers to send email communications, track delivery and engagement, and personalize outreach.
  • Marketing or promotional emails will only be sent if you have opted in or if permitted under applicable law.
  • You may opt out of marketing emails at any time by clicking “unsubscribe” in the email or contacting BarkPass support.

4. Do Not Track / Opt-Out Preferences

BarkPass respects your right to control how we communicate with you and how your information is used for marketing purposes:

  • Email Opt-Out: You may unsubscribe from marketing emails at any time by clicking the “unsubscribe” link included in the message or by contacting BarkPass support.
  • SMS Opt-Out: Reply STOP to any text message to stop receiving SMS marketing communications. Reply HELP for assistance.
  • Account Preferences: You may also manage your marketing and communication preferences directly in your BarkPass account settings or by contacting us.
  • Service Messages: Even if you opt out of marketing messages, we may still send important transactional or service-related communications (e.g., license renewals, account updates, urgent alerts).
  • Do Not Track Signals: At this time, our Service does not respond to browser “Do Not Track” signals. However, you can manage cookies and similar technologies through your browser settings.

5. Payments and Fees

All payments are processed securely by Stripe, Inc. BarkPass does not store credit card details. Fees for licenses, passes, or other services are set by the applicable municipality or organization, and payments are final except as required by law.


6. Third-Party Services

The Service may integrate with trusted third-party providers, including:

  • Twilio for SMS and voice communications
  • Stripe for payment processing
  • Instantly.io for marketing campaigns, analytics, and outreach
  • Hosting, analytics, and support vendors

BarkPass is not responsible for the availability, security, or content of third-party services, which are governed by their own terms and policies.


7. Intellectual Property

All content, trademarks, logos, and software used in the Service are the property of BarkPass or its licensors. You may not copy, modify, distribute, or create derivative works without prior written consent.


8. Service Availability

We strive to provide reliable access but do not guarantee that the Service will be uninterrupted or error-free. Certain features may depend on third-party networks (such as SMS delivery through mobile carriers or Instantly.io email delivery), which are outside our control.


9. Limitation of Liability

To the maximum extent permitted by law, BarkPass shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, profits, or service interruptions. Our total liability for any claim arising from the Service shall not exceed the amount you paid for the relevant license, pass, or service.


10. Indemnification

You agree to indemnify and hold harmless BarkPass, its officers, employees, and partners from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.


11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles.


12. Changes to Terms

We may update these Terms at any time. Updates will be effective when posted to this page. Continued use of the Service constitutes acceptance of the updated Terms.
